These Terms of Service ("Terms") govern your use of the CP Personal Training and Nutrition website and services. By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. About Our Services

CP Personal Training and Nutrition ("we," "us," or "our"), operated by Chris Pardoe, provides personal training and nutrition coaching services to clients in Kidderminster, Stourport, Bewdley, and surrounding areas in the UK.

Our services include but are not limited to:

  • In-person personal training sessions
  • Customized nutrition plans and coaching
  • Progress tracking and ongoing support
  • Exercise demonstrations and form guidance
  • WhatsApp support and accountability

2. Acceptance of Terms

By using our website or services, you confirm that:

  • You are at least 18 years of age, or have parental/guardian consent if under 18
  • You have the legal capacity to enter into a binding contract
  • All information you provide to us is accurate and truthful
  • You have read and understood our Privacy Policy and Health Disclaimer
  • You agree to comply with all applicable laws and regulations

3. Service Agreement and Booking

3.1 Booking and Confirmation

Services must be booked in advance through our booking system or by direct contact. All bookings are subject to availability and confirmation by Chris Pardoe.

3.2 Service Packages

We offer various service packages which may include different numbers of sessions, duration, and inclusions. Specific package details, pricing, and terms will be communicated to you before purchase.

3.3 Contract Period

Package duration and session validity will be specified at the time of purchase. Unused sessions may expire according to the package terms agreed upon.

4. Payment Terms

4.1 Pricing and Packages

Pricing is provided on a case-by-case basis depending on your chosen package, session frequency, and individual requirements. All prices are quoted in British Pounds Sterling (GBP) and include VAT where applicable.

We offer various pricing options including:

  • Introductory rates for new clients
  • Multi-session package discounts
  • Block booking savings
  • Flexible payment schedules tailored to your needs

Specific pricing will be discussed and agreed upon during your initial consultation. We reserve the right to adjust our standard pricing with reasonable notice to existing clients.

4.2 Payment Methods and Schedule

We accept payment via bank transfer, card payment, or other methods as mutually agreed. Payment terms and schedules will be agreed upon booking and may include:

  • Pay-as-you-go sessions
  • Monthly subscription payments
  • Upfront package payments with discounts
  • Customized payment plans

4.3 Late Payment

Payment is required in accordance with the agreed payment schedule. Failure to make payment by the agreed date may result in temporary suspension of services until payment is received. We reserve the right to charge interest on overdue accounts in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

5. Cancellations and Rescheduling

5.1 Client Cancellations

If you need to cancel or reschedule a session, you must provide at least 24 hours' notice. Cancellations made with less than 24 hours' notice, or failure to attend a scheduled session without notice, will result in the session being forfeited and charged in full.

5.2 Trainer Cancellations

We reserve the right to cancel or reschedule sessions due to illness, emergency, or unforeseen circumstances. In such cases, we will provide as much notice as possible and offer an alternative time or date. No charge will be made for sessions cancelled by us.

5.3 Weather and External Factors

Sessions may be cancelled or rescheduled due to adverse weather conditions, facility closures, or other factors beyond our reasonable control. In such cases, alternative arrangements will be offered.

6. Refunds and Cooling-Off Period

6.1 Cooling-Off Period

In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel services purchased online or remotely within 14 days of purchase without giving a reason. If services have already commenced with your agreement during this period, you will be charged a pro-rata amount for services provided.

6.2 Refunds for Unused Sessions

Refunds for unused sessions in a purchased package will be considered on a case-by-case basis, taking into account circumstances such as injury, relocation, or medical reasons supported by appropriate documentation. Any approved refund will be calculated at a pro-rata rate, less an administration fee.

6.3 No Refund Circumstances

No refunds will be provided for:

  • Sessions cancelled with less than 24 hours' notice
  • Missed sessions (no-shows)
  • Change of mind after the 14-day cooling-off period
  • Expired session packages that were not used within the validity period

7. Your Responsibilities

7.1 Health and Safety

You must:

  • Complete and return a health screening questionnaire before commencing services
  • Inform us immediately of any changes to your health status, injuries, or medical conditions
  • Obtain medical clearance from your GP if you have any health concerns or pre-existing conditions
  • Follow safety instructions and exercise guidance provided
  • Inform us if you experience any pain, discomfort, or unusual symptoms during exercise

7.2 Attendance and Punctuality

You are expected to arrive on time for scheduled sessions. Late arrival will result in a shortened session, as we cannot extend beyond the scheduled end time if other clients are booked.

7.3 Conduct

You agree to:

  • Behave respectfully and professionally at all times
  • Follow facility rules and guidelines where applicable
  • Not attend sessions under the influence of alcohol or recreational drugs
  • Wear appropriate exercise clothing and footwear
  • Respect the privacy and personal space of other clients and staff

7.4 Commitment

Achieving fitness and nutrition goals requires commitment and consistency. While we will provide expert guidance, support, and programming, your results depend on your adherence to the programme, attendance at sessions, and lifestyle choices outside of sessions.

8. Our Responsibilities

We commit to:

  • Provide services with reasonable care and skill in accordance with industry standards
  • Maintain appropriate professional qualifications and insurance
  • Respect your privacy and handle your personal data in accordance with GDPR and our Privacy Policy
  • Provide a safe training environment
  • Design programmes appropriate to your fitness level and goals
  • Maintain professional boundaries at all times

9. Liability and Insurance

9.1 Our Liability

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded or limited under UK law

9.2 Limitations

Subject to clause 9.1, we are not liable for:

  • Any injury, loss, or damage arising from your failure to disclose health information
  • Any injury occurring outside of scheduled sessions
  • Loss or damage to personal belongings
  • Indirect or consequential losses
  • Failure to achieve specific fitness or weight loss results

9.3 Professional Insurance

We maintain professional indemnity and public liability insurance as required by professional regulatory bodies.

10. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, training programmes, and nutrition plans, is the property of CP Personal Training and Nutrition and protected by UK and international copyright laws.

Training programmes and nutrition plans provided to you are for your personal use only. You may not reproduce, distribute, or share these materials without our express written permission.

11. Use of Images and Testimonials

We may request permission to use before/after photos, progress images, or testimonials for marketing purposes. Your consent is entirely voluntary, and you may withdraw consent at any time by contacting us in writing.

If you provide consent, you grant us a royalty-free, perpetual license to use such images and testimonials in our marketing materials, website, and social media.

12. Data Protection and Privacy

We collect, store, and process your personal data in accordance with the General Data Protection Regulation (GDPR) and UK data protection laws. Please refer to our Privacy Policy for full details on how we handle your data.

13. Termination

13.1 Termination by Client

You may terminate your service agreement at any time by providing written notice. Refunds for unused services will be handled in accordance with Section 6 above.

13.2 Termination by Us

We reserve the right to terminate services immediately if you:

  • Breach these Terms
  • Behave inappropriately or aggressively
  • Fail to make payment
  • Provide false health information
  • Repeatedly miss sessions without notice

In cases of termination due to your breach, no refund will be provided.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on this website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

Material changes affecting existing service agreements will be communicated to you directly with reasonable notice.

15. Force Majeure

We are not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to:

  • Acts of God (severe weather, earthquakes, floods, etc.)
  • Pandemic or epidemic
  • Government restrictions or regulations
  • Facility closures beyond our control
  • Strikes or industrial action
  • Failure of utilities or transportation

16. Complaints and Disputes

16.1 Complaints Procedure

If you have a complaint about our services, please contact us at chrispardoe89@mail.com with details of your concern. We aim to acknowledge complaints within 2 working days and provide a full response within 10 working days.

16.2 Alternative Dispute Resolution

If we are unable to resolve a complaint to your satisfaction, you may refer the matter to an alternative dispute resolution (ADR) provider. As a consumer, you also have the right to use the Online Dispute Resolution (ODR) platform provided by the European Commission.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of law, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Health Disclaimer, constitute the entire agreement between you and CP Personal Training and Nutrition regarding the use of our services.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the courts of England and Wales.

As a consumer, you have certain legal rights under the Consumer Rights Act 2015 and other UK consumer protection legislation, which cannot be excluded or limited by these Terms.
